The Club is operated by RH RESET MARTIAL ARTS LLC (‘The Company’) whose principal objective is to provide health and leisure facilities for Club Members and their Guests. The Home Club is where a member joins. The Company has appointed a management team (‘The Management’) who are responsible for the operation of the Club.
1. Membership
a) Memberships are personal to the member and are non-assignable, non-transferable and non- refundable. In exceptional circumstances a transfer will be considered at the discretion of the Club’s General Manager; however, an administration fee would be applicable. A member may not loan his/her membership card to be used by a third party. The Company may assign the benefit of these agreements to any person, firm or company at any time without notice to the member.
b) Any member wishing to enter the Club without a valid membership card will only be admitted at the absolute discretion of the Management.
i. All members shall pay an initial Start Up Fee as per the rate applicable at that time, these are non-refundable, including upon resignation or termination, and shall become immediately due upon being accepted as a member. Start Up Fees are subject to change without notice.
ii. Start Up fees and Membership fees are non-refundable upon resignation or termination for any reason whatsoever.
iii. The Management reserves the right to periodically review their prices, charges and fees and implement these accordingly.
iv. Monthly subscription is payable on the 1st of every month through credit card arrangements as indicated on the Membership Application Form.
v. Failure to use the Club or non-usage of the Club’s facilities does not eliminate the obligation to pay all the subscriptions on time, nor grants a refund.
vi. If for any reason your credit card becomes inactive, it is your responsibility to provide the club with new credit card details immediately. For payments that default on the 1st of the month they will be subsequently charged until the payment is collected. In such cases access to the club will be denied until the outstanding fees are paid. A ‘late payment fee’ of AED 50 + applicable taxes will be charged for all payments received after the 15th of the month. The collection dates may change in the future.
viii. AllamountspayableunderthisAgreementshallbeexclusiveofvalueaddedtaxorsimilar indirect tax (“VAT”). Where VAT is payable under this Agreement, the consideration for the supply of goods/services shall be increased by an amount equal to the amount of VAT, applicable at the prevailing rate at the time such supply is made. Payment of VAT, as applicable under law, is a prerequisite under this Agreement.
Freezing:
The membership under the management approval may be frozen under the memberships of three months, six months, and one year in case of illness or temporary injuries, or medical condition.
A report from a licensed doctor is required.
All proof must be presented to the process of frozen starts.
Memberships:
One month: Freezing not allowed
Three months: Freezing not allowed
Six months: Freezing is allowed for 7 days
Twelve months: Freezing is allowed for 15 days
Private Classes: Freezing is allowed one time only for a period of one week
Termination.
i. Members applying for‘ Termination’ from the Club must complete a form with the General Manager prior to the 25th of the current month, for the request to take effect the following month.
ii. All monthly paid memberships are open ended; therefore, we will continue to deduct membership dues until a request to cancel is received from the member. Monthly memberships do not automatically cancel after the initial minimum term indicated. Such requests must be made in writing to the Club’s General Manager before the 25th of the month for the next month to be considered as the last month of dues. The member shall obtain a confirmation in writing from the club that the Termination has been applied.
2. Physical Condition of Members
a. The member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in an active or passive exercise program and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
b. It is the member responsibility to update the club in writing with any information that might affect their ability to engage safely in physical activity in clubs.
c. The member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
d. Members and their guests exercise and use the facilities at their own risk and are advised to consult their physician prior to commencing any type of physical exercise.
e. For any monthly membership you have to complete the minimum term for any membership adjustments to be made.
f. Memberships are available to individuals who are a minimum of 16 years of age. Any applicant below 16 and above 14 years of age must produce a letter of consent by the parent/guardian, however all visits must be accompanied by the parent/guardian.
Uniform code:
All members are required to use the team uniform.
Kimono class:
Use a rash guard under the kimono jacket.
No Gi:
Use spats
3. Limitation of Liability
a. In consideration of the Management accepting his/her application for membership of the Club and for him/her becoming and remaining a member of the Club, the member agrees that:
b. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI accepts no responsibility for loss, for damage to members ’or their guests ’properties of, for death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against the Company RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI, the management, coaches or staff for any reason whatsoever.
c. RENZO GRACIE DUBAI, RH RESET MARTIAL ARTS LLC, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to member’s personal property arising out of or in connection with the use by a member of any of the services, facilities on the premises of RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI. The member hereby holds the Company, RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI, employees and coaches harmless from all claims which may be brought against them by or on a member’s behalf for any such injuries or claims aforesaid.
d. Any advance payments towards jiu jitsu classes, academy usage or any other payable activates, will not be refundable or transferable.
e. Any surrounding areas or facilities that are not under the direct management of RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI, the Company accepts no liability for any injury or loss incurred through use of these facilities.
f. Promotions:
i. You must bring the original voucher to be eligible for promotion redemption with a unique Voucher Code number given to you
ii. You must follow the redemption rules as stated on the voucher
iii. Not redeemable for cash & not exchangeable
iv. One voucher per person
v. Lost vouchers will not be replaced and only original voucher must be handed in to reception vi. The earliest the voucher can be redeemed is in the last month of your minimum contract term that excludes any freeze period
vii. Valid at RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI. Restrictions may apply
viii. Membership must be valid/active and clear of arrears at the time of using their voucher ix. Voucher allows entry to the existing membership tier only
x. Voucher redemption remains subject to Management discretion
xi. This email cannot be used to claim the free month promotion in case where the original voucher mentioned in point 1 has been lost
xii. It is the member responsibility to ensure that they meet the stated above T&C's to enjoy the promotion
4. Expulsion of Members
The management may terminate the membership of any member:
a. Without notice and with immediate effect if a member’s conduct, whether or not such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of the Club without notice and with immediate effect if the Company is of an opinion that the member shall have committed any breach of RH RESET MARTIAL ARTS LLC‘RENZO GRACIE DUBAI Rules & Regulations ’that the Club has in place.
b. If a member is rude, aggressive or in any way disrespectful to another member or to any of the RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI employees, this includes foul/bad language.
c. If any monthly membership fees or any other fees such as Private Training etc. remain unpaid after the due date for payment.
d. Upon notice in writing, if the Company is of the opinion that the member is not a suitable individual for continued membership of the Club.
e. If a member is found to have violated the privacy of any other member within the shower and the changing rooms or are caught in lewd or compromising actions, this includes ignoring or disrespecting the Club’s ‘No Nudity ’policy in the changing room area.
A member whose membership is terminated by the Management shall forfeit all the privileges of membership with immediate effect without claim of any refund of his/her initial Start Up fee or Monthly membership dues, other than any monthly membership dues paid in advance. On termination of his/her membership the member will be required to return his/her membership card and any other evidence or property of membership provided to that member by the Club and shall settle any outstanding debts.
5. PRINCIPAL TERMS
a. This agreement commences once you have indicated your acceptance of our Terms and Conditions.
b. Your membership starts immediately unless you have requested for a delayed start and you
have received confirmation of the approved delayed start.
c. This agreement will become binding on you and us and you will be entitled to all the rights and privileges exercisable for the type of Membership chosen.
d. You cannot transfer this agreement/membership to anyone else.
e. The Laws of the United Arab Emirates shall cover the Terms & Conditions, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in the United Arab Emirates.
6. PAYMENT METHOD
a. We accept payment by Visa or MasterCard Debit or Credit cards and Cash in AED for our memberships and other products and services.
b. Payment confirmation Via email to the vernal address you provide at the point of registration will be issued within 24 hours of successful processing of your payment.
c. You, as the cardholder must retain a copy of transaction records and Merchant policies and rules.
d. You are responsible for maintaining the confidentiality of your membership account and payment details.
7. DATA SECURITY
a. In the course of completing your membership, we may collect certain personal information about you including personal details and information about your health and person. We will use this information for purposes including managing your membership and communicating with you. You have the duty to keep your personal information up to date and to inform us of any significant changes.
b. We will limit access to the processing of and use of your personal information to our employees and management who may, from time to time, require its use for marketing or other services. In addition, from time to time, we may need to make your personal information
available to third parties such as legal authorities, our group companies and professional advisors.
8. DRESS CODE
a. All members are required to wear proper gym attire when exercising.
b. Members should remain modestly and appropriately dressed at all times, including in the changing areas.
9. LOCKERS
Temporary lockers are provided for the members who shall remove their personal belongings at the completion of their visit. Renzo Gracie Dubai has the right to cut open any padlocks and remove personal belongings that are left in the lockers at the end of each day.
10. BEHAVIOUR
a. Members and guests must treat the Renzo Gracie Dubai facilities and one another with respect; failure to comply shall constitute a serious breach of the terms of membership and could result in the loss of membership,
b. Threatening, intimidating or abusive behavior will not be tolerated towards any member of staff. Should such incidents take place a member's membership will be immediately suspended.
c. We reserve the right to prevent access to, or use of, the facilities by anyone deemed to be acting inappropriately or behaving in an unacceptable manner, as determined by RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI management.
d. Any anti-social or offensive behavior will result in the member or guest being immediately evicted from RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI and your membership cancelled.
e. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI Social Media platforms are intended as a means of creating community, facilitating communications, and providing a forum for the expression of feedback. Inflammatory posts, including any content which is judged by our management at its absolute discretion to consider inappropriate, may be subject to remedial action, including removal of the offending posts, blocking access, and termination of membership as a consequence of serious misconduct.
f. Good personal hygiene is mandatory, and any member who causes offence will be asked to remedy the offending problem or leave Renzo Gracie Dubai and membership may be cancelled at Renzo Gracie Dubai management sole discretion.
11. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI FACILITIES
a. The management accepts no responsibility for theft or damage to a member's personal belongings kept in the lockers or otherwise for any reason whatsoever.
b. The use of mobile phones with camera features and/or and other types of visual records in changing rooms are strictly prohibited, and members are requested to ensure that they do not offend any other person when utilising such equipment within our facility.
c. Members and guests are not allowed to bring their own food into the Training Area.
d. The normal hours of operation are as indicated from time to time at the Renzo Gracie Dubai
entrance and notice board. The management reserves the right to adjust the hours for the purpose of cleaning decorating, repairs and special private functions and holidays.
12. GENERAL TERMS
a. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI may terminate this agreement with immediate effect on notice to you if you are in breach of RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI rules or these Terms and Conditions.
b. The RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI management reserves the right to use any individual or group photographs or video of members and or guests for press or promotional purposes (by RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI or our partners) in both online, TV and print sources.
c. All members must abide by RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI rules of the which may be amended and/or added to from time to time at the management's discretion.
d. Failure by the management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
e. Members and or guests are not allowed to photograph or copy any of our facility's interior
designs, promotional materials, tag lines, themes or concepts. We reserve the right to proceed with legal action against any member caught distributing, sharing or supplying such contents to any third-party vendor or competitor.
f. The RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI website may automatically
produce search results that reference and/or linked to third party sites throughout the World Wide Web. We have no control over these sites or content within them. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI does not guarantee, represent or warrant that content
contained in the sites is accurate, legal and/or inoffensive. RH RESET MARTIAL ARTS LLC, RENZO GRACIE DUBAI does not endorse the content of any third-party site, nor does it make any representations or warranty about these sites, including that they will not contain viruses or otherwise impact your computer.
